Mother sues hospital for wrongful birth case

Stuart Bramley comments: "Whilst the circumstances of this case are tragic, it is the case that wrongful birth claims are only allowed by law should the child be injured. If, for example, a birth should occur following a failed vasectomy or sterilisation and a healthy child is born as a result, a claim cannot normally be brought."

"The difficulties with which Rupert is faced for the rest of his life are sadly very similar to those a child suffering from cerebral palsy might experience, and he will require constant care for life. As such it is important that his parents have been able to secure damages from the NHS Hospital at fault to finance the costs of providing Rupert with appropriate levels of care he will require."
