From April 2011, the Bribery Act 2010 will change the existing law on bribes and will cover offences committed both in the UK and abroad.
The 4 main offences will be: bribing another person, accepting a bribe, bribing a foreign public official and the most controversial offence: failure of commercial organisations to prevent bribery, regardless of whether they were aware of it or not. Commercial organisations include companies and partnerships formed under UK law or carrying on business in the UK.
Because of the offence of failing to prevent bribery, urgent consideration should be given to reviewing employment contracts, policies, procedures and contracts with agents and contractors.
