Residential Parks – Pitch Fee Reviews – deadlines!

If your pitch fee review date is 1 June 2011 and not all of your residents have agreed the review for 2011, you might be running out of time to make an application to the Residential Property Tribunal (RPT) to set the reviewed pitch fee for the year.

If you served a valid pitch fee review letter on or after 30 April 2011 giving not less than 28 days' notice before 1 June 2011 you will have until 31 August 2011 to make an application to the RPT to set the pitch fee for 2011.

If you served a valid pitch fee review letter less than 28 days before 1 June 2011 you will have 4 months from the date the notice was served to make an application to the RPT to set the pitch fee.

If you served a valid pitch fee review letter before 30 April 2011 you do not need to worry! You will have until 29 April 2012 in which to make an application to the County Court to set the pitch fee.

If you miss a deadline, you will be prevented from asking the RPT (or the Court if the last example applies to you) to set the pitch fee for this year UNLESS you have good reason.

Knowing about the deadlines imposed by the new regulations is important and park owners should ensure that they have procedures in place so that no deadline is missed.
