On 3rd August 2011 the Government released its consultation on the introduction of a new mandatory possession ground for ASB. Whilst the Government's intentions are well placed in seeking to allow landlords to recover possession more easily where the tenant has a conviction or ASB had already been 'proven' by another Court, the ground is unlikely to be quite as 'bullet-proof' as the Government would have us believe given the ability for a tenant to challenge the proportionality of making a possession order under the principle in Pinnock.
