Intellectual property update: Protecting your business assets

A new law came into force on 1 October 2011 to help small and medium sized businesses protect their intellectual property (IP) rights.

The Patents County Court (Financial Limits) Order (No.2) 2011 creates a damages cap of £500,000 for all claims in the Patents County Court (PCC). One of the ideas behind the PCC is to encourage small and medium sized businesses to protect their IP and to be able to do so in a more user friendly, cost effective way.

The legislation can be found at http://www.legislation.gov.uk/uksi/2011/2222/contents/made
