Three changes in employment law happened over the weekend.
Firstly, the default retirement age has now officially been removed. It is still possible to retire someone under the old procedure if they received a retirement notice before April, but not otherwise. The law now says that retirement will only be lawful if an employer can prove an Employer Justified Retirement Age ("EJRA"). Practically speaking, it is going to be very hard for most employers to justify any kind of retirement age. We are presenting a series of seminars on this topic, full details can be found here.
Secondly, the Agency Workers Regulations 2010 came in to force. They provide temporary workers with certain rights from day one of their placement, including access to facilities and the right to be notified of employment vacancies. More comprehensive rights are available to temporary workers after 12 weeks, including the right to receive the same pay as a comparable employee.
