Issuing a Claim

We regularly advise on claims from £1,000 to over £100,000 and offer a fixed fee debt recovery service for issuing proceedings (please see our fixed fee price list). The fixed fees are cost neutral and the cost will be added to the amount claimed from the debtor.

We also offer a fixed fee service for letters before action. We are strong advocates of resolving disputes without resorting to court proceedings and a letter before action is an effective way of promoting a response from your debtor. We always advise clients to send out a letter before action before proceedings are issued. Issuing Proceedings

• If a letter before action is not successful then we will issue proceedings for you. Alternatively, it may be appropriate instead to serve a statutory demand on the debtor.
• If you would like us to issue proceedings or a statutory demand we can do so, in most cases, within a week of receiving your instructions.
• In addition to our fixed fee, there is a court fee to pay which is based on a sliding scale according to the value of the claim and which is also added to the amount your debtor must pay. The current court fee can be found on the fixed fee menu below. Finally, we make sure the claim includes interest which can be either based on your contract, at the court rate or in accordance with the Late Payment of Commercial Debts (Interest) Act.
• After proceedings are issued the debtor has 14 days to respond and if they do not respond we request judgment for a fixed fee (which is also added to the judgment together with further interest accruing).
• Once you have a judgment the debtor is obliged to pay immediately. If they do not you will need to consider your enforcement options and you can click here to find out more about enforcement. Alternatively, it may be appropriate instead to serve a Statutory Demand on the debtor.
