We know this is a worry when considering whether to bring a claim.
Normally the party who loses the legal case is responsible for the other party's legal costs. Therefore, if you are successful, the opposing party will pay all or most of your legal costs in addition to any compensation.
The position on payment of costs under a 'no win no fee' agreement and privately funded cases will be discussed by your lawyer at the very outset of your claim. We will not charge you for their work if the claim is unsuccessful.
We ensure that our clients understand fully all aspects of their chosen funding option at the outset.
Only firms of solicitors who have been approved by the Legal Service Commission (LSC) - such as Tozers - can offer legal aid to their clients to fund their claim.
Very limited legal aid is available for investigative work for serious high cost cases.
In order to qualify for legal aid your lawyer must certify to the LSC that your claim has reasonable prospects of success - you are also obliged to show you are financially eligible for legal aid.
We offer conditional fee agreements as a funding option. This option is not always appropriate for every case. We will ensure that your funding options are fully explored.
On occasion, it may be worth funding a claim by paying the lawyer's hourly rates as the claim progresses, together with the fees for the provision of medical notes, expert reports, and the like. Our team will explain this option to you and whether it is a sensible option for you in your particular circumstances.
A majority of household policies have pre-existing legal expenses cover. We will investigate whether you have existing before the event insurance that may cover the cost of bringing your claim. It is not uncommon for such insurances to be extras to your household or contents insurance, credit cards, motor insurance, or even as part of a benefits package with a trade union or other membership. We will explain to you how such insurance can be utilised to your best advantage at the initial interview.
