Mr X and the defendant had been out drinking. Mr X was permitted to sleep in the defendant's car and was asleep on the back seat. Without Mr X's knowledge the defendant got into the car and began to drive down a path and then hit a bollard.
Mr X was hospitalised for 1 night. He sustained a soft tissue injury to his neck with a 50% chance of ongoing symptoms. Mr X also had permanent neck spasms and small facial lacerations.
Mrs W was staying at the defendant's hotel when she tripped and fell by catching her foot on a loose wire lying across a dark carpet in the hotel's dining room.
The fracture site required plating and Mrs W underwent surgery. Mrs W later developed a chronic pain disorder.
Mr S was a passenger in a vehicle being driven by his wife. The accident occurred when the defendant drove his van into the passenger side of the vehicle in which Mr S was travelling.
Mr S had a pre-existing rotator cuff tear. As a result of the accident the rotator cuff was further torn which limited his ability to use his arm above shoulder height.
Miss S was a passenger in a vehicle that was struck from behind by the defendant. Miss S sustained soft tissue whiplash injuries to her neck that lasted for approximately 3 months. The back injury lasted for approximately 18 months after which she made a full recovery.
Multiple applications to the CICA were made on behalf of adults who had suffered sexual abuse at the hands of their teacher whilst at school. We appealed the original awards of £5,500 for these applicants on the basis of ongoing and recognised psychiatric injuries.
