Assured Shorthold Tenancies – have you registered your deposit?

The Housing Act 2004 required any deposits paid by a tenant under an assured shorthold tenancy (“AST”) created on or after 6 April 2007 to be registered in a Tenancy Deposit Scheme (“TDS”).

This provision has now been extended to apply to most ASTs created before 6 April 2007 as well. If you granted any ASTs before 6 April 2007 to tenants who remain in occupation then you may need to register your deposit in a TDS by 23 June 2015. If you do not then it may not be possible to recover possession of the property when you need to do so and there may also be financial penalties.
