Stephen Jennings, partner and employment law specialist at Tozers, comments:

“This issue shows the difficult issues that can be faced when trying to establish what equality means. Ironically in this case the equality issues arise directly out of well-intentioned attempts to make the state pension more equal. Claims involving equality issues can often be complex and high risk for employers. They also are often highly emotive for employees and be particularly difficult to get right. While it remains to be seen how this case will turn out, it is always sensible to take professional advice when equality issues arise with a view to minimising the risk of challenge.”
