    What can I expect

    1. File Your Divorce

      Submit a divorce application (individually or jointly) to the court to officially start the process. This includes details about you, your spouse, and your marriage.

    2. Confirm & Proceed

      Your spouse receives a copy and completes an Acknowledgement of Service form, confirming they will not contest the divorce. After this, you can apply for the Conditional Order (after 20 weeks).

    3. Finalise the Divorce

      Once the Conditional Order is granted, you can apply for the Final Order (after 6 weeks). Once issued, your divorce is final—keep a copy for future use, especially for financial or legal matters.

    Divorce & Separation FAQs

    A divorce petition is filed at Court in triplicate with the Court fee and marriage certificate. The Court fee is currently £593. If you are on a low income or benefits you may be able to apply for some or all of the fee to be exempt.

    There is now a minimum period of 20 weeks between the start of proceedings, a current minimum time frame of 6 weeks between Conditional Order and when the order can be made final, with an overall minimum timeframe of 6 months.

    There is a court fee to issue the divorce petition which is currently £593. If you are on a low income or benefits you may be able to apply for an exemption for some or all of the fee. Tozers' specialist family law solicitors offer a fixed fee for divorce proceedings. This is currently £600 plus VAT.

    No Fault Divorce allows couples to divorce in an amicable manner, without the need for one spouse to blame the other. Spouses are also not be able to contest the divorce, apart from on grounds such as coercion and fraud. This also applies to civil partnership dissolution.
