Divorce & Finances – The Family Justice Council publishes guidance on finances

The FJC has published a new guide for litigants in person, Sorting out Finances on Divorce.

The guide provides information for separating couples who are negotiating their own financial agreements. The Guide gives a very useful analysis of the process and makes it clear that in complex cases Legal advice should be sought.

No Fault Divorce Bill

The Second Reading of the Bill has been postponed yet again. It has now been postponed until the next parliamentary session which commences on 18th May 2016 as there are no available days fixed for the Second Reading before the end of the current session.

Increase in Divorce Fee

The court fee payable on filing for divorce has increased from £410 to £550 nationwide from 21 March 2016. It has previously been reported that the actual costs of divorce to the court service is £270. Tozers’ continues to offer a fixed fee divorce service.

95% of separating couples head to court

New figures from National Family Mediation show that only one in 20 applications in private law proceedings to a family court following a referral to mediation. Since April 2014 attendance at a Mediation Information and Assessment Meeting (MIAM) has been compulsory although these figures show that many separating couples are choosing to ignore this route. However, what the statistics do not reveal is how many cases have benefitted from mediation and have thereby avoided the court process altogether.
