First tier tribunal decisions – park rule appeal

In a recent tribunal case a homeowner’s application to appeal the park rules proposed by their park owner was dismissed.

The tribunal’s reasoning for dismissing the application is as follows. Regulation 10 of the regulations provides that where a homeowner wishes to appeal the park rules proposed by the park owner they must make an application within 21 days of receiving the consultation response document and must also give the park owner notice of the application being made in that 21 day period.

The homeowner failed to give the park owner notice of their application and therefore failed to comply with the regulations. For this reason the tribunal refused to hear the applicant’s case.
