Fit and proper person test – do you fit the bill?
The Mobile Homes Bill will introduce a requirement that the manager of a site is a ‘fit and proper person’.
The new requirement means that land cannot be used as a protected site unless the Local Authority is satisfied that the occupier is a fit and proper person to manage the site or that a person appointed by the occupier is a fit and proper person to do so. The Local Authority may apply to the Residential Property Tribunal to have a site licence revoked if they believe that a site owner is in contravention of this requirement.
Local Authorities will be required to keep a register of fit and proper persons and to keep this register up to date.
The fit and proper person test will not come into force immediately and will instead take effect on a future date, which has yet to be decided. We will provide an update on this blog as soon as further information becomes available.
