Vicarious liability (as it is known) arises where there is a sufficient connection with the employment – crunch points often arise where there is a limited connection with work, e.g. at an office party or works event. Vicarious liability can arise even if the employer itself has committed no wrong, although there are steps an employer can take to prevent or limit liability.
