Lasting Powers of Attorney are an invaluable tool which should be added to everyone’s succession planning arsenal.

Lasting Powers of Attorney allow you to appoint someone to make decisions on your behalf.  These powers will remain in place even if you lose your ability to make decisions yourself; allowing your attorneys to ensure that everything continues to run smoothly for you come what may.

There are two types of Lasting Powers of Attorney: property and financial affairs and health and welfare.

The predecessor to the Lasting Power of Attorney was the Enduring Power of Attorney, although EPAs made before the transition may still be in effect. These types of powers permitted the donor to appoint attorneys to make decisions about their financial affairs only.
