Certain activities that take place on your property could give rise to a “statutory nuisance”.
A nuisance can be caused by noise, smoke, fumes, gases, odours and artificial light if it interferes with the health and safety, or comfort of the public at large. If a Local Authority serves you with an abatement notice, you will need to either comply with the notice or appeal against it. Failure to comply with an abatement notice can result in a prosecution and lead to substantial fines. Our team can advise you of your rights and defend you at an appeal or will seek to reach a compromise with the Local Authority depending on the circumstances. If you are facing a prosecution we can defend you in the Magistrates’ Court.
