The Civil Proceedings, Family Proceedings and Upper Tribunal Fees (Amendment) Order 2016

A Draft Statutory Instrument entitled ‘The Civil Proceedings, Family Proceedings and Upper Tribunal Fees (Amendment) Order 2016’   has been laid before parliament for consideration which proposes significant increases to family court fees.

It suggests that the fee for filing a divorce petition should rise from £410 to £550, the fee for filing an on notice application where no other fee is specified to rise from £155 to £255; and the fee for an application made either by consent or without notice where no other fee is specified should rise from £50 to £100.

We will have to wait to see whether the draft order is approved. However, for anyone considering divorce proceedings it may be prudent to avoid any unnecessary delays in doing so as it could save you money.
