Tribunal decisions – the importance of getting the pitch fee review date right

In July 2013 a park owner served a review proposal which gave 1 October 2013 as the review date. Unfortunately the Mobile Homes Act agreements said the review date was 26 September.

The Tribunal thought that the proposal was invalid. It was not a valid on time review because it did not use the correct review date. It was not a valid late review because a late review has to be proposed after the correct review date has passed.

This is an interesting decision. We think there are some points which might be decided differently on another occasion. However, the clear message is that it pays to get the paperwork right if at all possible. We can help you with this.
