Wife Awarded Share of Husband’s Pension

Caroline Ryan acted for a Wife who was married for over 40 years. Her Husband worked in the Public Sector and was possessive of his pension. The Husband put forward offers throughout the court proceedings offsetting the capital that would be available upon a sale of the former matrimonial home. Even following the involvement of a Pensions Expert the Husband’s position did not change.

The Wife was advised that she was entitled to a share of her husband’s pension. Following the Pension Expert’s Report it became clear that the Wife would be able to retire immediately upon implementation of a pension sharing order.

A Pension Sharing Order was pursued and it was eventually possible to achieve an agreed settlement providing the Wife with her own pension pot as well as a capital pot with which to purchase her own home. The Wife retired shortly thereafter.
