What is the updated Statement of Truth?

From 6 April 2020 the statement of truth is being updated.

What is the statement of truth?

The statement of truth is a statement, to be included in any statement of case, witness statement, expert's report and certain other documents, that confirms that the facts stated in the document are true.

How is the statement of truth changing?

The statement of truth should now state the following, with additions highlighted in bold:

"[I believe][the (claimant or as may be) believes] that the facts stated in this [name document being verified] are true. I understand that proceedings for contempt of court may be brought against anyone who makes, or causes to be made, a false statement in a document verified by a statement of truth without an honest belief in its truth."

What is the statement of case?

A statement of case is a document in which a party sets out its case. A statement of case may be a:

  • Claim Form
  • Particulars of Claim
  • Defence/Reply
  • Counterclaim
  • Request or Reply for Further Information

Clients, where preparing their own statements of case or witness statements, should be particularly aware and amend any precedent documents they use.
