What is Hypoxic Ischaemic Encephalopathy (HIE)?

Hypoxic Ischaemic Encephalopathy, commonly known as HIE, is a type of brain injury caused when the brain does not receive enough oxygen and blood flow.

HIE can occur before birth, during labour and delivery, or shortly after a baby is born. The severity and effects of the injury can vary considerably from one child to another. In some cases, HIE may occur because of complications that could not have been prevented. However, there are circumstances where a failure to recognise or respond appropriately to problems during pregnancy, labour or after birth may cause or worsen an avoidable brain injury.

 What causes HIE?

There are many possible causes of HIE. A baby may be deprived of oxygen or blood flow because of problems affecting the placenta, umbilical cord, the mother's health, or complications during labour and delivery. Not every case of HIE is caused by medical negligence. Establishing what caused your child's injury requires careful investigation of the medical records and, usually, expert medical evidence.

How are children affected by HIE?

The effects of HIE can vary significantly depending on the severity and circumstances of the brain injury. Some children may make a good recovery, while others can experience long-term or lifelong difficulties. Depending on the extent of the injury, HIE can be associated with conditions and difficulties including:

  • Cerebral Palsy
  • Developmental delay

When can you make an HIE claim?

There are strict time limits for bringing medical negligence claims, although different rules can apply depending on the circumstances and whether the injured person is a child.

Generally, a claim must be brought within three years of the date of the negligence or the date when the person became aware, or ought reasonably to have become aware, of the injury and its potential connection with medical negligence. There are important exceptions for children. In many circumstances, the three-year limitation period does not begin until the child reaches the age of 18.
