A recent report by the Public Accounts Committee (PAC) has drawn sharp attention to the escalating cost of clinical negligence within the NHS, with total liabilities now reported as £58.2 billion.
This figure marks a new record and places clinical negligence among the government’s most significant financial exposures, second only to nuclear decommissioning.
The PAC’s findings point to deeper, systemic issues around patient safety and risk management in healthcare settings. With £2.8 billion paid out in damages last year alone (2024’s NHSR’s report put the figure at £2.1 billion), the financial strain of avoidable harm has prompted calls for reform in how claims are handled and prevented.
While the report acknowledged that the government has begun reviewing aspects of regulation and liability, it also criticised the Department of Health and Social Care for delays in delivering a strategic response. Concerns were particularly acute in areas such as maternity care, where recent failings have led to serious and lasting consequences for families.
The wider implications of these rising costs are significant. Beyond the financial burden, high volumes of litigation often reflect a lack of transparency, communication and early resolution; areas that could be improved through stronger governance and cultural change across the NHS.
At a time when the health system faces ongoing reform and resource pressures, the PAC has urged the government to prioritise a coherent plan for patient safety, reduce dependency on litigation and better protect the resources needed for frontline care.
