Leading legal specialists in Erb's Palsy compensation claims

Have you or your child been affected by Erb’s Palsy as a result of sub-standard care?

Living with Erb's Palsy can be emotionally and financially stressful but you may be able to claim compensation to support your needs.

As one of the country’s leading Erb’s Palsy legal teams, our specialist solicitors have conducted over 300 cases with families like yours, and we have a strong track record in securing maximum compensation.

We know that making a claim can feel daunting. We're here to guide you through the process, usually on a no-win, no-fee basis.

Could you claim for Erb's Palsy compensation?

What is Erb's Palsy and when can you claim compensation?

Erb’s Palsy is an injury commonly caused to a baby during birth when the shoulder becomes stuck after the head has been delivered (shoulder dystocia) and the brachial plexus nerves in the trapped shoulder are stretched and injured.

This is often the result of medical staff using excessive force on your baby's shoulder during birth. While the majority of children make a full recovery with prompt treatment, some can be left with lifelong injury.

Medical professionals should recognise the signs of shoulder dystocia and take clear steps to solve the problem. You may be able to claim compensation if the medical professional didn't:

  • Use the correct tools/force during the birth
  • Advise you about the potential risks of birth injuries
  • Acknowledge signs that can cause Erb's Palsy
  • Refer you for a caesarean section in the likelihood of a problematic birth
  • Take steps to move your baby out of a trapped position

Generally, claims should be made within three years from the date you or a loved one suffered medical negligence (although there are exceptions, such as in the case of children where the three-year limit doesn't start until after their 18th birthday).

Our friendly and approachable team will:

  • Talk to you about your situation in a free initial assessment - We establish if the care you were given fell below a reasonable standard and that damage was caused by these failings.
  • Discuss your options for funding the claim - There are various ways to do this, including Legal Aid or no-win, no-fee.
  • Guide you through the process, with clear and honest advice - We explain everything carefully and answer your questions so that you know what to expect at each stage, keeping you fully informed throughout.
  • Identify and instruct the best medical experts and barristers - We work closely with everyone involved to ensure the claim has the best chance of success.

Our Erb's Palsy solicitors are recognised as experts in their field and have achieved some of the highest awards for damages in the country.

We're recommended by the Erb's Palsy Group, having worked closely for over 25 years to raise awareness of Erb’s Palsy and how the injury can be avoided. This gives us an in-depth knowledge of both the medical and practical issues, and what is needed to ensure a successful claim.

How can Erb's Palsy compensation help you and your child?

Our starting point is that your financial settlement should give you the means to navigate the future, giving you funds to cover all medical, equipment and care needs.

Compensation can also be used for associated costs such as parents taking additional time off work or if your child has had their future earning potential impacted.

Making a claim can also be about recognising the impact this experience has had on your life. We know that often this isn't simply a physical injury - there can also be associated psychological and emotional problems. As a parent, it can be very difficult to cope emotionally after what is likely to have been a traumatic birth, as well as looking after a child who may be facing lifelong disability.

Getting the right support and advice is often as important as obtaining a financial settlement.

"I heard about Tozers through the Erb’s Palsy Support Group, and from the minute I telephoned I felt that they understood."

"I liked the fact that no matter how many times I called or asked questions I was never made to feel stupid or like I was wasting people’s time."
