What is Erb's Palsy and when can you claim compensation?

Erb’s Palsy is an injury commonly caused to a baby during birth when the shoulder becomes stuck after the head has been delivered (shoulder dystocia) and the brachial plexus nerves in the trapped shoulder are stretched and injured.

This is often the result of medical staff using excessive force on your baby's shoulder during birth. While the majority of children make a full recovery with prompt treatment, some can be left with lifelong injury.

Medical professionals should recognise the signs of shoulder dystocia and take clear steps to solve the problem. You may be able to claim compensation if the medical professional didn't:

  • Use the correct tools/force during the birth
  • Advise you about the potential risks of birth injuries
  • Acknowledge signs that can cause Erb's Palsy
  • Refer you for a caesarean section in the likelihood of a problematic birth
  • Take steps to move your baby out of a trapped position

Generally, claims should be made within three years from the date you or a loved one suffered medical negligence (although there are exceptions, such as in the case of children where the three-year limit doesn't start until after their 18th birthday).
